Kroy “KJ” Biermann Jr.’s lawyer defended his client after prosecutors shockingly claimed in court they found videos on the teen’s phone allegedly showing him having sex with an underage family member.

“The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case,” Jason Sheffield said in a statement obtained by Page Six.

“The matter arose from inappropriate, crude behavior involving two middle-schoolers,” he continued. “It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense.”

Sheffield added, “Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”

Sheffield’s statement comes as the 15-year-old was granted bond following Friday’s bond hearing.

His bond was set at $200k, according to court docs obtained by Page Six. He also must stay at his mom Kim Zolciak’s home, attend school virtually, no social media of any kind or cellphone use, no direct or indirect contact with victim or her family or associates, no contact with anyone aged 16 or under.

Things took a dramatic turn during inside Georgia’s Fulton County Superior Court earlier in the day, as Deputy District Attorney Caitlin McGillicuddy shockingly revealed that investigators previously found videos on KJ’s cell phone that allegedly depicted him having penetrative sex with a family member under the age of 12.

McGillicuddy claimed there were “multiple encounters” on video that were discovered on KJ’s device and that they allegedly showed him using “predatory, derogatory” language toward the victim.

“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims,” McGillicuddy noted.

McGillicuddy also said KJ was previously charged with sexual battery of a victim under the age of 16 — information which had not been publicly reported until now — and that he’d been under court supervision since October 2025 following the alleged incident with the family member, which she said was reported in April 2023.

The new revelation comes after KJ was arrested Aug. 17 for aggravated sodomy (a forceful act involving the mouth or anus) and aggravated battery.

His arrest stemmed from allegations that he’d assaulted a female classmate — who described herself the “best friend” of KJ’s girlfriend — in the co-ed sauna at the Life Time fitness center in Alpharetta, Georgia, on April 23, according to court documents obtained by Page Six.

The alleged victim was examined the following day at the North Fulton hospital in Georgia and there was no evidence of male DNA in her mouth or vagina, per the police report.

Following KJ’s arrest, his lawyer, Jason Sheffield, told Page Six the teen was “100% innocent.”

Kim Zolciak, also defended her son against what she called “reckless” and “deeply troubling” allegations in an exclusive statement to Page Six on Aug. 21.

The teen was officially indicted on seven charges — aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of aggravated sexual battery against a child under 16 and false imprisonment — on Sept. 3.

Sheffield filed documents in the Superior Court of Fulton County last week requesting a bond hearing for his client, citing good character, strong academics, football achievements and scholarship offers.

“The accused turned 15 years old in May. He is a high school student in good standing who has demonstrated strong academic achievement and regularly participates in extracurricular and community-based activities,” KJ’s lawyer argued in the filing obtained by Page Six.

In his plea for bond, Sheffield — who has also requested KJ be transferred to juvenile court instead of being tried as an adult — told Judge Melynee Leftridge, “This has been so traumatizing to [KJ] personally. He is not a boisterous kid. He is somewhat quiet.”

He asked that his client be released on $65,000 and insisted that Zolciak — who showed up to court looking stone-faced — would monitor him, as she is at home and not currently employed.

McGillicuddy noted that the victim in the April incident had “documented physical injury” as a result of the alleged encounter and asked the judge to set KJ’s bond — should it be granted — at $190,000.

A statement from the alleged victim was read aloud in court, in which she said she’d been “living in fear” over alleged threats that KJ would come after her and her family if he were if he were to be released.

The alleged victim added, “The thought of him being released scares me more than I can put into words.”

KJ — who has been jailed at Atlanta’s Metro Regional Youth Detention Center since his arrest last month — remained emotionless throughout the hearing.

The teen was also supported in court by his father, retired NFL star Kroy Biermann, who sat by himself in front of Zolciak and the reality star’s eldest daughter, Brielle Biermann, in the courtroom gallery.
