Amazon is facing a lawsuit over Prime Video‘s Off Campus. Brass Jar Inc., the company behind the live theatrical brand Drunk Shakespeare, has accused Amazon of using its trademarks without permission. The lawsuit focuses on the fourth episode of the YA hockey romance series and its use of the “Drunk Shakespeare” name.
According to Variety, Brass Jar filed the lawsuit in the U.S. District Court for the Southern District of Florida on September 17. The company claims Off Campus used its registered “Drunk Shakespeare” and “Drunk” trademarks without authorization. It also argues that the use could confuse viewers into believing the theatrical production endorsed or licensed the series.
The dispute centers on Episode 4, titled “The Breakup.” The episode features Hannah and Garrett attending a fictional college production called Drunk Shakespeare. The sequence includes multiple references to the name, which Brass Jar alleges goes beyond incidental use of its trademark..
Brass Jar says it contacted Amazon about the alleged trademark use on June 3, several weeks after all eight episodes premiered. According to the lawsuit, Amazon’s response addressed copyright infringement even though Brass Jar’s initial complaint concerned trademarks. The company later proceeded with the lawsuit.
The lawsuit does not specify how much money Brass Jar is seeking. However, the company says it could receive attorneys’ fees, treble damages, and statutory damages of up to $2 million per counterfeit mark for each type of service or good covered by the law. Amazon has not publicly responded to the lawsuit.
