Halle Berry’s ex files restraining order accusing her of strangling son and demands sole custody

Halle Berry has spoken out after her ex-husband, Oliver Martinez, filed a restraining order, accusing the actress of strangling their 12-year-old son

Halle Berry has been accused of strangling her 12-year-old son, in a legal filing. The actress’s former husband, Oliver Martinez, filed a temporary restraining order against the actress, citing allegations of physical abuse towards their son, Maceo.

In the documents, Martinez alleged that Halle jumped on him, placed her hands around his neck and choked him. He said Maceo phoned him and claimed that Halle had physically assaulted him, also alleging that this was not an isolated incident and had happened before.

Martinez also alleges that Halle threatened to have him deported to France. He is now seeking sole custody of their son, Marceo, citing allegations of physical and emotional abuse.

A legal representative for Halle has since responded to the claims, saying, “misleading would be an understatement.” In a statement to Fox News Digital addressing the claims, they said: “To say this filing is entirely meritless and deliberately misleading would be an understatement. There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo — misconduct for which Mr. Martinez has already been legally sanctioned.

“In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behaviour. Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”

In the legal documents, Olivier alleges that Halle caused him to suffer “emotional and mental distress due to physical abuse of our minor child, Maceo.” He adds that the actress “physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him.”

The documents continue: “While the September 26, 2026, incident in which Petitioner choked our son is the latest incident of abuse, I contend that there have been other instances of abuse over the course of the last few years.

“These other incidents involve additional physical attacks against our son, as well as verbal and emotional abuse from Petitioner to me.”

Halle has now been ordered to stay 100 yards away from Oliver as part of the temporary restraining order, and she can now see her son only during court-ordered visitations, two days a week and every weekend, until a hearing on October 16, reports TMZ.

The pair, who divorced in 2016, have been ordered to attend confidential mediation about custody arrangements. He also claims that Halle angrily walked into their child’s bedroom, saw him wearing virtual reality goggles and said he looked “so stupid” while playing a game.

After allegedly assaulting him, she is said to have shouted: “Who is dominant now?” In the filing, Olivier claims that Maceo phoned him and said he’d been attacked by his mother.

The filing also says that Halle must not be under the influence and must have sobriety testing before, during and after visits with Maceo.

The Mirror has approached Halle’s representatives for comment.
